A recent ruling by the Federal Court of Justice (BGH, 5 StR 488/09) reaffirms that a photocopy, which is clearly recognizable as a reproduction, does not constitute document forgery. In the present case, the defendant had printed a scanned notarial document, where the scan had been altered beforehand (whether by the defendant himself is unclear). The printed version produced by the defendant deviated from the original, and the regional court ruled it as document forgery. However, the BGH overturned this ruling.
Indeed, a photocopy can be considered a document – provided the photocopy is designed in such a way that it could be mistaken for an original. Especially with notarial documents, it must be considered that additional special features (such as the seal) are often present, which were not included in the printed version. Therefore, the BGH concluded:
The mere printout of the computer file did not exhibit the typical authenticity features that characterize a notarial purchase contract or its official copy. It merely reflected an image of another document, clearly identifiable to the observer as such. As a result, it was equivalent to a simple photocopy, which, being a reproduction, cannot be attributed document status due to a lack of evidentiary value and the inability to identify the issuer.
